Commercial Lease Work-Outs and Litigation in the New Economy

The Building Owners and Managers Association (BOMA) held its annual international conference at the Long Beach Convention Center from June 27-29, 2010.  On June 28, Brian Frasch and Megan Adeyemo joined a Director of Cushman & Wakefield to provide a presentation entitled, Commercial Lease Work-Outs and Litigation in the New Economy. The presentation addressed new developments in commercial landlord-tenant litigation, the potential impact of federal bankruptcy laws, and the complex set of regulations governing situations where tenants face financial difficulties.  The presentation was prominently featured as one of only two sessions focusing on the legal aspects of the commercial real estate market, and the conference materials specifically noted that "California often leads the markets—in asset value and prices and in regulatory challenges. From mandatory energy benchmarking to bankruptcy law, California's regulations are often adopted by other states."
