Rosemary Carson specializes in construction law counseling involving:

  • Contract drafting and negotiation (including AIA, AGC, ConsensusDocs, IPD, Public Contract Code, Partnering agreements);
  • Public works;

  • Bidding (preparation, substitution, protests);
  • Green building construction (assessing and minimizing risk, contract language, LEED requirements, sustainability issues, BIM);
  • Unfair business practices;
  • Commercial defect/delay claims including differing site conditions, inefficiency, acceleration, suspension, impact, ripple, sufficiency of project plans and specifications;
  • Litigating contract disputes;
  • Residential defect claims involving large developers or high-end residences;
  • Construction remedies (mechanics liens, stop notices, performance/payment bond claims, prompt payment laws);
  • Labor issues;
  • Insurance, surety and indemnification;
  • Minority contracting issues.

Ms. Carson has represented owners, developers, contractors and subcontractors on numerous and varied public and private projects. She counsels clients through every aspect from contracting to litigation, including: early assessment and minimization of liability exposure and risk; cost-effective dispute resolution; project counseling to work through claims and disputed change order requests; strategy development for crafting a winning defense or prosecution; negotiating payment on projects with distressed parties, funding or bankrupt entities; and litigating cases through resolution via mediation, arbitration, or trial.

Ms. Carson has extensive experience in multi-party litigations enabling her to act as a key liaison between clients, opposing counsel, public entities and officials, various experts, and joint defense or prosecution teams. 

Construction projects at issue have included multiple-story parking structures; underground pipeline systems; luxury hotels, both ground-up and renovation projects; airport construction; concrete demolition, cutting and pouring for a utility company; resort construction and upgrades; power and geothermal power energy plants; Army barracks and associated campus; light-rail projects; community colleges; landscaping on public works; a large grocery-store chain's warehouse and distribution center; LAUSD renovations; micro-tunneling under a large river bed; and multiple residential developments (homes, condos and townhomes).
