
Ms. Yuo-Fong “Benni” Amato is an associate in the San Diego office. She is a member of the Intellectual Property practice group. Her practice mainly consists of trademark, copyright, patent, and trade secrets litigation; trademark registrations; licensing agreements; Uniform Domain-Name Dispute-Resolution Policy (“UDRP”) arbitration proceedings; and proceedings before the Trademark Trial and Appeal Board. She has represented both plaintiffs and defendants, ranging from exercise machine companies to Internet social publishing companies, and more.
In addition to her intellectual property practice, Ms. Amato also has experience with commercial and business litigation, professional liability defense, and the Telephone Consumer Protection Act (“TCPA”).
Ms. Amato has trial and post-trial experience, but she has also obtained early victories for clients: She has obtained multiple preliminary injunctions against infringers in trademark/patent cases; she has successfully moved to dismiss copyright infringement claims by arguing safe harbor protection under the Digital Millennium Copyright Act; she has also successfully moved to dismiss a group of actresses' misappropriation of likeness claims under copyright preemption principles.
Ms. Amato is a fluent speaker of Mandarin Chinese.
