Phillip Maltin is a partner in the Employment and Commercial Litigation practice groups in Gordon & Rees’s Los Angeles office. As an employment lawyer, Mr. Maltin defends businesses against all forms of employment-related claims from harassment and discrimination to class action lawsuits alleging violations of the Fair Labor Standards Act and the California Labor Code.  Phil also handles business-related claims involving trade secrets protection and complex and technical business interference claims.

 

For businesses of all sizes, Mr. Maltin acts as outside general counsel supplying day-to-day human resources counseling and strategy, and successfully protecting his employer-clients from lawsuits. He drafts employment policies and handbooks.  He is also nationally recognized as leader in conducting workplace investigations of wrongdoing and teaching others how to conduct them.

 

In commercial disputes, Mr. Maltin represents corporations in a variety of actions including breach of contract, breach of fiduciary duty, breach of warranty, interference with contract, breach of confidentiality and misappropriation of trade secrets. He has recovered millions of dollars for businesses victimized by civil fraud and embezzlement.

 

His clients include national and international corporations located in the United States, Asia and Europe. He understands the unique aspects of commercial disputes, many of which erupt along with pressure to maintain a business relationship between the disputing parties (such as with key vendors, alliance partners, joint business owners and investors). Mr. Maltin knows how efficiently and cost-effectively to balance trial advocacy with alternative dispute resolution, permitting his clients to focus on business not on lawsuits.

 

As a trial lawyer and nationally recognized speaker, Mr. Maltin combines his knowledge of substantive law with experience gained as both a criminal prosecutor and private attorney. Mr. Maltin from time to time prosecutes criminal cases for the City of Los Angeles through the Fellowship Program of the prestigious Trial Advocacy Project (“TAP”), where he is a fully credentialed Instructor. He has received the award as “TAP Outstanding Alumnus,” the only time the award has been given. He speaks throughout North America on trial techniques and evidence, on body language and how to identify liars, on leadership and on how to protect against (sexual) harassment claims.  Mr. Maltin frequently comments on high-profile legal matters on NBC. 
 
Mr. Maltin is perennially recognized as a Southern California Super Lawyer, an elite distinction given to no more than five percent of the Southern California Bar.
