Tort Litigation Group Wins Big Defense Verdict for Bike Manufacturer and Wal-Mart in $8M Liability Claim

Fletcher Alford, a partner in the San Francisco office, with assistance from Kelly Savage, Jewel Basse and Shaye Hester recently won an eight week trial in Marin County Superior Court for their clients Dynacraft BSC Inc. of San Rafael and insurance adjuster Carl Warren & Co.  The civil lawsuit was filed against Wal-Mart, Dynacraft, and Carl Warren & Co. on behalf of the families of nine boys who were injured after the front wheels of their bicycles feel off while they were riding.  The suit alleges that Wal-Mart, which sold the bicycles, and Dynacraft, the manufacturer, knew the bicylces were dangerous because of complaints from users but failed to report the alleged defects to government regulators while continuing to sell the bicycles.  The Plaintiff's counsel asked the jury to award the nine families $8 million in compensatory damages and an unspecified amount in punitive damages.  After four days of deliberation, the jury delivered a complete defense verdict on all causes of action.
