In a highly uncommon action, the National Labor Relations Board in Oakland dismissed an Unfair Labor Practice charge alleging that Dan Berkley's nursing home client had terminated five nursing workers due to union related activities. The investigation lasted over a two month period, capped by several days of affidavit taking and document gathering and production, as well as a 40 plus page position statement. This action by the NLRB clears the way to an overall resolution of years long charges and problems, allowing the employer to resume operating its business.
