Gordon & Rees Obtains Intellectual Property Jury Verdict

Gordon & Rees recently obtained a complete jury verdict after a one week trial in favor of our client, Pacific Sunwear of California, Inc. The first trial of an issue of this kind in California, the verdict followed nearly five years of litigation and a published opinion from the 4th District Court of Appeals, which for the first time announced California law on the requirements for a merchant to enforce the implied warranty against third party claims of infringement against goods made or sold by another merchant under Cal. Comm. C. Sect. 2312(b)(3).

The Gordon & Rees team was led by San Diego partner Kimberly Howatt, with assistance from Orange County associate Marc Holmquist and Dallas senior counsel Steve Lawson. The work of the Gordon & Rees team resulted in a nearly one million dollar judgment in favor of our client.
