Gordon & Rees Partner Kai Peters to Present at ABA Life Sciences Legal Summit at Genentech

On March 4, Gordon & Rees San Francisco partner Kai Peters will present on the topic of preemption of claims involving pharmaceutical products and participate in a panel discussion at the American Bar Association's Life Sciences Legal Summit.

Peters' session at the Life Sciences Legal Summit, "Generic Drug Preemption and Innovator Liability Update," will be held from 11:20 a.m. - 12:10 p.m. at Genentech in South San Francisco. Other panel members include plaintiffs’  lawyer Steven Skikos, partner at Skikos, Crawford, Skikos, & Joseph. This panel will address developments over the last year in preemption for generic drug manufacturers and innovator liability claims against brand-name manufacturers, including the recent defense victory in the propoxyphene litigation in the Sixth Circuit, Germain v. Teva Pharms., USA, Inc. (In re Darvocet, Darvon, & Propoxyphene Prods. Liab. Litig.), 756 F.3d 917 (6th Cir. 2014), a case which addressed “failure to update” claims and innovator liability claims and which has been recognized as one of the top decisions of 2014. Peters currently acts as a national counsel in the propoxyphene litigation.

The day-long summit will focus on the latest on cutting-edge legal and technical issues relevant to those practicing in pharmaceutical, medical device, and biotechnology arenas. Attendees will hear from federal and state courts judges, preeminent attorneys, industry figures, leading trial and appellate lawyers, and in-house counsel as they give their thoughts and insights on the most compelling issues in mass tort litigation issues faced by life science companies.

Peters is a member of Gordon & Rees’ Drug and Medical Device and Life Sciences Practice Groups. He handles complex commercial litigation, with an emphasis on representing pharmaceutical, medical device, and other U.S. Food and Drug Administration-regulated companies, solar companies, and high-tech and new media companies.  Peters acts as national and local litigation counsel for companies of all sizes in state and federal courts, including multidistrict litigation and coordinated proceedings, and has recovered significant sums in breach of contract matters.  He also acts as outside general counsel advising clients on a variety of business matters related to corporate, commercial, transactional, litigation, and regulatory issues.
