Allison Fernandez is a partner with the Commercial Litigation, Privacy, Data & Cybersecurity, Employment, and Consumer Protection Litigation practice groups. She handles a wide variety of litigation matters at both the state and federal level, including complex commercial disputes, class actions and multidistrict litigation (MDL), products liability, employment law, intellectual property, and professional liability.
Ms. Fernandez has extensive experience defending retailers, debt collectors, and other businesses in consumer class action litigation, including claims arising under the Fair Debt Collection Practices Act (FDCPA), Fair and Accurate Credit Transactions Act (FACTA), California’s Rosenthal Fair Debt Collection Practices Act (RFDCPA), and the Fair Credit Reporting Act (FCRA). She has successfully defeated class certification in a nationwide putative class action alleging claims under the Telephone Consumer Protection Act (TCPA).
Ms. Fernandez has also successfully defended corporate officers and directors in shareholder derivative suits, securities fraud, and breach of fiduciary duty claims. She has additionally represented employers in the defense of discrimination, harassment, retaliation, and wrongful termination claims.
