Amy Darby is the managing partner of the firm’s Tampa office and a member of the firm's Construction, Employment, and Commercial Litigation practice groups. Ms. Darby's construction litigation practice includes representing builders, developers and design professionals in construction defect actions and other types of construction disputes. She has handled several complex, high dollar cases to a successful resolution on behalf of her construction clients. Ms. Darby has litigated construction cases involving multi-family and single family construction defect, infrastructure defect, commercial delay claims, allegations of fraudulent land deals, special district cases and bid protests.  On behalf of her builder client, she tried a construction defect case with admitted mold and defects in the installation of stucco resulting in no damages and costs being awarded to her client.

Ms. Darby has also successfully resolved cases in the early stages of litigation through pre-trial motions to dismiss. In a fraud case involving a real estate transaction, Ms. Darby secured the dismissal of a $2 million dollar claim. On behalf of her architect and engineer clients, Ms. Darby understands the technical, substantive issues on which construction claims are based and aggressively defends such claims to secure resolution as early as possible. Ms. Darby counsels her clients through every phase of litigation, from pre-litigation strategy to efficiently defending or prosecuting claims to achieve a final and cost-effective resolution in her client's best interest.

Ms. Darby’s commercial practice involves class actions and complex business disputes, specializing in matters involving franchising and non-compete agreements. She has also litigated employment matters including wrongful termination.
