Environmental & Toxic Tort
Mr. Strunk is particularly adept at handling complex litigation involving the defense of toxic injury product liability and premises liability claims involving asbestos, mold, and airborne and water-borne contaminants and chemicals. He represents manufacturers of heavy industrial equipment, such as valves and pumps, automobile engine gasket and brake manufacturers, flooring materials, pesticide and fertilizer manufacturers and suppliers, and multinational chemical and petrochemical companies. He has also successfully defended cases involving exposure to contaminants at sea (and in port) under federal maritime law, including Jones Act claims and claims brought under the Longshore and Harbor Workers' Compensation Act, as well as claims involving premises owners and alleged toxic exposures on those premises. Mr. Strunk also has a wealth of experience in traditional environmental law, having been extensively involved in litigation involving federal (including CERCLA and RCRA) and state environmental statutes. He has recently successfully litigated a “first of its kind” case involving toxic tort liability for a supplier to the medical cannabis industry.
Over the course of his 18 year career, Mr. Strunk has accrued significant first and second chair experience in both trials and binding arbitrations in multiple state and federal jurisdictions. He has taken and defended well over a thousand depositions, including plaintiffs, corporate representatives, experts and percipient witnesses, and successfully argued dozens of dispositive motions. He is also adept at overseeing and managing complex litigation in a national counsel role, and has spearheaded coordination of statewide discovery and investigation for several major industrial manufacturers.
Acknowledging that the best defense in litigation is to avoid being sued in the first place, Mr. Strunk counsels clients on compliance with state and federal environmental statutes, and has assisted clients in drafting product warnings and other liability-limiting documents in proactively seeking to limit downstream litigation risks.
In the commercial context, Mr. Strunk has significant experience in traditional products and premises liability litigation, as well as experience with business litigation, including business torts, breach of contract claims, insurance coverage, and bankruptcy.
Business Transactions & Counseling
Mr. Strunk has also assisted and counseled numerous businesses, large and small, on all aspects of business formation, operation, and dissolution. In the process, Mr. Strunk has drafted numerous agreements and documents, including operating agreements, vendor agreements, policies and procedures, commercial leases, liability releases, rights agreements, and agreements governing ownership of intellectual property. At all times, Mr. Strunk draws on his wealth of litigation experience in an effort to limit risk.
Mr. Strunk is an experienced rock musician of two decades and a veteran of multiple San Francisco-based bands. He has a special appreciation of the issues facing fledgling musicians seeking to expand their reach and fan base. In this regard, Mr. Strunk has represented the needs of unsigned artists in selecting corporate forms to limit liability, and has negotiated and drafted agreements with venues, promoters, recording studios, commercial enterprises and former band members, involving performance, use of copyrighted material, and licensing.
