David M. Rosenfield is Of Counsel based out of the Denver office of Gordon & Rees and is a member of the Construction, Energy and Commercial Litigation practice groups. In the energy and construction sectors, recently, Mr. Rosenfield has successfully represented a large municipality in varying matters relating to issues such as energy production, energy acquisition, and biomass power plants in disputes involving damages in excess of $100 million. In the commercial litigation context, Mr. Rosenfield also recently defended a textiles and composites manufacturing company sued for trade secret misappropriation, while simultaneously countersuing for malicious prosecution and tortious interference, ultimately mediating the case to a successful resolution. Finally, presently, Mr. Rosenfield is defending a chemical manufacturing company being sued for allegedly exposing its former factory workers to potential harmful irritants, requiring Mr. Rosenfield to depose over 200 plaintiffs over the course of the next year, a process he is almost halfway through.
In addition to his aforementioned recent experience with energy, construction and commercial litigation, Mr. Rosenfield also spent much of his career pursuing insurance coverage under policies ranging from commercial general liability to mass property/casualty to directors’ and officers’ liability to errors and omissions to kidnap and ransom insurance, all resolved by way of litigation, mediation and arbitration. Mr. Rosenfield’s representations ranged from large publicly traded Fortune 500 corporations to small to mid-market private companies covering industries as diverse as commercial banking, mortgage lending, aviation, horse breeding and health and fitness. In particular, for many years, Mr. Rosenfeld was the lead associate, overseeing fifty contract attorneys and dozens of fellow associates, representing one of the largest commercial banks and mortgage lenders in the United States in pursuing coverage against numerous insurers for mortgage defaults in amounts exceeding one billion dollars.
Finally, Mr. Rosenfield’s commercial litigation experience also includes products liability, breach of contract and securities fraud and he is particularly skilled at contract drafting, interpretation and negotiation as well as in managing large discovery budgets and navigating large document review databases, particularly using Relativity. Mr. Rosenfield also has several publications, both academic and practice-related.
Prior to joining Gordon & Rees, Mr. Rosenfield was an Associate with Winston & Strawn in Chicago and with Reed Smith in Chicago and New York and as well as a law professor at an international university in Asia.
