Heather Kelly’s practice focuses on complex commercial litigation, professional liability and employment matters. A Colorado native, Ms. Kelly regularly defends clients before federal courts, state courts and government agencies in both Colorado and Wyoming.

Ms. Kelly is co-practice group leader of the firm’s professional liability group as well as co-chair of the firm’s professional liability webinar series. She routinely defends lawyers, physicians, directors, officers and accountants in discipline and malpractice matters. She has successfully defended national, regional and local law firms at trial and on appeal. Ms. Kelly has served as Chair and Co-Chair on multiple jury trials. She has also argued before the Colorado Court of Appeals and through the appellate process, has assisted in making law favorable to the defense of professional liability claims in Colorado.

Ms. Kelly has represented individuals as well as Fortune 500 companies in complex commercial disputes, ranging from contract disputes, trade secret enforcement actions, disputes over the sale and dissolution of a multi-million dollar business and class actions.

Ms. Kelly has successfully defended clients against Title VII of the Civil Rights Act of 1964, Americans with Disabilities Act, Age Discrimination in Employment Act, Family and Medical Leave Act, Fair Labor Standards Act and Fair Housing Act claims. She also advises clients on numerous labor and employment issues, including employment policies, compliance with wage and hour laws, settlement offers and mediation.

In addition to her practice, Ms. Kelly frequently lectures on various topics affecting attorneys and the practice of law; including ethics, privileges, confidentiality, and technology. She has authored several articles, which have been published in the Colorado Lawyer and DRI’s For the Defense, for which she received the G. Duffield Smith Outstanding Publication Award.
