Heidi Gumienny is partner in the Houston office of Gordon & Rees LLP. Ms. Gumienny is a member of the firm's Commercial Litigation, Employment Law, Labor, and D&O and Shareholder Litigation groups. Her practice focuses on complex commercial litigation, employment, labor and municipal liability. Ms. Gumienny has both trial and arbitration experience, has appeared before state and federal courts and has represented clients in administrative proceedings.  She has also participated in the briefing of appeals before the Texas Courts of Appeals, the Texas Supreme Court, the United States Courts of Appeals for the Fifth Circuit and the Sixth Circuit, and other courts.  Ms. Gumienny has also briefed and argued appeals before the Houston Court of Appeals. 
 
Ms. Gumienny defends numerous municipalities and local governments in state and federal lawsuits involving premises liability, personal injury, takings, and civil rights claims under the Texas Tort Claims Act, Section 1983 and the Texas and U.S Constitution.
 
In addition, Ms. Gumienny represents public and private employers in litigation in federal and state court, and in administrative proceedings before the Equal Employment Opportunity Commission and the Texas Workforce Commission, Human Rights Division, in wrongful termination, discrimination, retaliation, harassment, wage-and-hour, worker's compensation, restrictive covenant and state whistleblower protection disputes and counsels clients concerning policies and practices, employee investigations and wage and overtime issues.  Her experience includes drafting employment policies and addressing issues related to the hiring, retention and firing of employees. 

Ms. Gumienny has also defended both privately owned and Fortune 500 companies in complex commercial and business disputes, involving both contractual and non-contractual claims.

Biography
