Biography

Jason C. Kalkirtz is Senior Counsel in the Alexandria and Washington, D.C. offices of GRSM and a member of the Business Transactions, Advertising & E-Commerce, Cannabis, Hemp & CBD, Government Regulatory & Administrative Law, Intellectual Property, and Drug & Medical Device practice groups. Jason focuses his practice on regulatory, transactional, litigation, and compliance matters involving a variety of consumer products, including food, beverage, dietary supplement, medical food, drug, medical device, and cosmetic products. Jason has in-depth experience navigating the evolving regulatory landscape at both the federal and state level. In particular, he counsels clients with regulatory compliance matters relating to FDA, FTC, USDA, U.S. Customs, EPA, TTB, and Consumer Product Safety Commission regulations.

Jason advises clients at all stages of product development. With a technical background in biological science (with a concentration in chemistry), Jason is comfortable analyzing scientific literature to help enable his clients successfully navigate the complexities of government regulations. He works closely with clients to ensure product formulations and ingredients meet FDA, USDA, and other applicable safety requirements. Jason counsels on labeling requirements and marketing claims for all media, including websites, social media, print, radio, and television advertising for compliance with applicable regulations. He has substantial experience evaluating consumer product claims including nutrient content, health, disease, structure/function, and qualified health claims. Jason regularly defends clients in challenges from the FDA, USDA, FTC, State Attorney Generals, false advertising class action lawsuits, and before the Better Business Bureau’s National Advertising Division.
