Leon Silver is a co-managing partner at Gordon & Rees's Phoenix office. He is the firm’s National Practice Group leader for Retail & Hospitality and a member of the Commercial Litigation, Privacy & Data Security and Employment practice groups. With more than 25 years of experience handling complicated business and real estate trials, arbitrations, mediations and appeals, Mr. Silver has a proven record of success in the most difficult, high dollar disputes the firm's clients have faced.

Mr. Silver represents national and multi-national retailers, restaurants, hotels and management companies, as well as manufacturers, sophisticated real estate investors and developers, small businesses and business people.  As leader of the firm’s Retail & Hospitality practice group, he provides counsel to his clients on all aspects of their business operations, including, in particular, employment advice and litigation defense, protection of proprietary information, diversity and inclusion in the workplace, privacy and data security, and “bet the company” litigation. His expertise extends beyond retail, to "E-tail", Internet of Things (IoT) and MLM business models.
 
Examples of his successes on behalf of clients include:
 
  • Obtained a defense jury verdict on an $11 million claim by a vendor for alleged wrongful returns, unearned discounts, and breach of the duty of good faith and fair dealing regarding the sale of vendor’s power products (scooters, generators, lights) in client's stores. Jury agreed with our view that balance of the account was only $10,733. The decision was over-turned by a split panel of the Arizona Court of Appeals, but Mr. Silver successfully petitioned for review by the Arizona Supreme Court, which reversed and reinstated the trial result.
  • After several key employees left his client’s technology company, absconded with proprietary information and created a competing business overseas, in violation of the restrictive covenants contained in their employment contracts, he conceived of and directed the filing of claims against a number of affiliated entities in five separate lawsuits in U.S. and European courts, resulting in a favorable settlement of all claims and counterclaims in the client’s favor.
In addition to his practice, Mr. Silver is a frequent public speaker and author. An accomplished artist, Mr. Silver's paintings have been featured in magazines and can be found in offices, homes and public spaces across the country.
