Megan M. Mitchell is a Senior Counsel in the Houston office of Gordon & Rees and is a member of the Employment Law and the Product & General Liability practice groups. She has litigated employment claims for businesses and individuals, including claims arising under the Fair Labor Standards Act (FLSA), Title VII, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Texas Commission on Human Rights Act (TCHRA), the National Labor Relations Act (NLRA), the Sarbanes-Oxley Act (SOX), the False Claims Act, the Family Medical Leave Act (FMLA) and similar federal and state statutes and regulations. Ms. Mitchell represents clients before the Equal Employment Opportunity Commission (EEOC) and the Texas Workforce Commission (TWC) by writing position statements and conferring with investigators.  Ms. Mitchell also handles wage and hour investigations brought by the Department of Labor and handles workplace investigations.

Ms. Mitchell’s practice also includes a tort and product liability matters, including defending claims brought against businesses, in state and federal courts and arbitration.

Wage & Hour Experience: FLSA litigation included independent contractor misclassification, the administrative, executive, professional, and highly compensated employee exemptions, and day rate compensation systems. Venues have included, Colorado, Florida, Georgia, and Texas federal courts.

Trial Experience: Represented clients in jury trial and arbitration proceedings as second chair attorney; examined plaintiff for approximately 8 hours in a single-plaintiff FLSA overtime case tried in February 2018; conducted closing argument in the same trial; prepared and deposed witnesses for depositions and trial; permanent injunction hearing experience.

Mass Arbitration Experience: Handled 146 individual arbitration proceedings (before arbitrators across the country) simultaneously under the FLSA.
