Michael J. Nesse is an associate in the firm’s New York and New Jersey offices, and is a member of the Labor & Employment Law practice group. Mr. Nesse focuses his practice on defending employers in employment litigation and counseling management on both transactional and litigation-related labor and employment law matters. He represents clients in both state and federal court, as well as before governmental agencies such as the Equal Employment Opportunity Commission (EEOC).
Mr. Nesse regularly represents publicly and privately held companies in a wide variety of industries, including health care, real estate, education, insurance, hospitality, service and retail. He has extensive experience representing these and other clients in various areas of labor and employment law, including actions involving claims of discrimination, harassment, retaliation, wrongful discharge, and breach of contract. His practice also encompasses advising employers and management on matters relating to the development and implementation of personnel policies, employment agreements, employee handbooks, and compliance with federal, state, and local employment and human rights statutes.
Mr. Nesse also has extensive experience counseling and representing employers in wage-and-hour matters. Mr. Nesse represents clients in both individual and putative class and collective wage-and-hour lawsuits, often involving claims regarding minimum wage, overtime, and misclassification of employees. He also counsels employers on best practices for recordkeeping obligations and compliance with local, state, and federal labor laws. Mr. Nesse also has experience representing clients in the hospitality industry, such as restaurants and bars, regarding the payment and distribution of tips and tip pooling arrangements.
