DRI Profiles New York Employment Team's Summary Judgment Victory in Retaliation Case

DRI member Mercedes Colwin obtained summary judgment on a Title VII retaliation claim on behalf of a national employer in the U.S. District Court of the Northern District of New York. The plaintiff claimed she was subjected to numerous discrete acts of "retaliation" by various supervisors over a nearly nine year period, and was eventually discharged after having filed a claim of harassment against the employer.  In this compelling decision, the Court agreed with the defense that there was no continuing violation theory in retaliation cases brought under Title VII.  The case was profiled in the April 27, 2011 issue of The Voice, the weekly electronic newsletter from the Defense Research Institute.
